AI Use Disclosure
Section 1 — We use AI throughout the Services
You acknowledge and agree that the Kornugle Parties (collectively, “Kornugle,” “we,” “our,” or “us” — including without limitation Cubierto Insurance LLC, Hogares Mortgage LLC, Finazo LLC, Kornugle Group LLC, and Cubierto Corredores de Seguros, S.A. de C.V.) use artificial intelligence, machine learning, large language models, generative AI, automated decision systems, computer vision, voice recognition, natural language processing, and similar technologies (collectively, “AI”) throughout the websites, mobile applications, AI assistants, WhatsApp services, telephone services, and all related properties (collectively, the “Services”). The Services use AI to:
- operate chatbots, virtual assistants, and conversational interfaces (including, without limitation, those interacting with you on websites, by WhatsApp, by SMS, by voice, and by email);
- generate product recommendations, quote comparisons, suggested actions, content summaries, and translations;
- support, but not solely determine, underwriting, claims handling, fraud detection, and identity verification;
- process voice notes, photographs, video, and uploaded documents (including, without limitation, photographs of vehicles, properties, and personal identification documents);
- personalize the experience you receive on the Services;
- measure and improve the performance of the Services; and
- any other AI use we determine, in our sole discretion, to be appropriate.
Section 2 — AI is informational only — do not rely without independent verification
YOU ACKNOWLEDGE AND AGREE THAT ANY OUTPUT GENERATED BY AI ON OR IN CONNECTION WITH THE SERVICES IS PROVIDED “AS IS” AND “AS AVAILABLE” SOLELY FOR INFORMATIONAL PURPOSES. AI OUTPUT MAY CONTAIN ERRORS, OMISSIONS, INACCURACIES, FABRICATIONS (COMMONLY CALLED “HALLUCINATIONS”), OR OUT-OF-DATE INFORMATION. AI OUTPUT IS NOT, AND SHOULD NEVER BE INTERPRETED AS:
- Insurance advice
- Mortgage or lending advice
- Investment advice
- Legal advice
- Tax advice
- Medical advice
- A binding quote, offer, policy, loan commitment, or contract
- A substitute for advice from a qualified, licensed professional
You are solely responsible for evaluating, verifying, and confirming the accuracy of any AI output before relying on it for any decision, action, or purpose. You acknowledge and agree that you must consult an appropriately licensed insurance agent, mortgage broker or lender, financial advisor, attorney, accountant, or other qualified professional for any recommendation, decision, or transaction that affects you. No AI output shall be deemed advice from Kornugle, any Kornugle Party, or any of its officers, directors, managers, members, shareholders, employees, agents, or contractors.
Section 3 — No reliance — release — indemnity (AI errors)
TO THE FULLEST EXTENT PERMITTED BY LAW, AND IN CONSIDERATION OF YOUR ACCESS TO AND USE OF THE SERVICES, YOU HEREBY:
- RELEASE Kornugle, its officers, directors, managers, members, shareholders, employees, agents, contractors, service providers, successors, and assigns (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees), of every kind and nature, known or unknown, arising out of or in any way connected with: (i) any AI output (including hallucinations, errors, inaccuracies, omissions, or out-of-date information); (ii) your reliance on any AI output; (iii) any decision you make, action you take, or action you fail to take based in whole or in part on AI output; and (iv) any third party's reliance on AI output that originated through your use of the Services;
- WAIVE any and all rights and benefits conferred upon you by the provisions of California Civil Code § 1542 (and similar provisions of any other applicable jurisdiction), which provides: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party”; and
- INDEMNIFY AND HOLD HARMLESS the Released Parties from any and all third-party claims arising out of or in any way connected with AI output that you shared with, communicated to, or relied upon in dealings with any third party.
Section 4 — Training data — your authorization
By using the Services, you grant Kornugle and each Kornugle Party a perpetual, irrevocable, worldwide, royalty-free, fully-paid, sublicensable, transferable license to collect, use, store, copy, modify, distribute, display, perform, derive works from, reverse engineer, and otherwise exploit:
- your queries, prompts, commands, messages, and other inputs to AI;
- your conversations and transcripts with chatbots, virtual assistants, voice agents, and live agents;
- recordings of any voice notes, phone calls, video sessions, or WhatsApp audio you provide;
- photographs, videos, and other media you upload (including, without limitation, vehicle photos and property photos for insurance inspection);
- documents you upload;
- your profile data, preferences, and behavior data on the Services; and
- any other information you provide or that we collect about you (collectively, “User Data”),
for the purpose of training, fine-tuning, refining, developing, evaluating, benchmarking, validating, deploying, and improving AI models, machine learning algorithms, automated decision systems, fraud-detection systems, voice-recognition systems, computer-vision systems, recommendation systems, and other predictive or analytical technologies (collectively, “AI Models”) operated by, on behalf of, or licensed to Kornugle, any Kornugle Party, or any successor or assignee of any of the foregoing.
This license survives termination of any service relationship with you and survives the deletion or de-identification of your User Data. You acknowledge that once your User Data has been incorporated into a trained AI Model, opt-out cannot remove it from that AI Model.
4.1 Limited opt-out
You may opt out of prospective training-data use, for User Data we collect after the opt-out is effective, by contacting us at privacy@kornugle.ai. Opt-out:
- Is prospective only;
- Does not apply to User Data already incorporated into trained AI Models;
- Does not apply to use of User Data for fraud detection, security, identity verification, compliance, audit, or operation of the Services as you have requested;
- Does not apply to de-identified, anonymized, or aggregated data; and
- Does not alter or limit any of the licenses granted in this Section 4 for previously-collected User Data.
4.2 Carve-outs from training
We do not knowingly use the following for AI Model training:
- Payment-card primary account numbers (PANs), full bank account numbers, and full Social Security numbers (we may use tokenized or hashed equivalents);
- Communications you have identified to us in writing as protected by legal privilege; and
- Any data category that applicable law specifically prohibits from being used for training.
Section 5 — No use of AI output to compete with us
You agree not to (and not to permit any other person to) use any AI output from the Services, or the Services themselves, to: (a) train, fine-tune, develop, validate, or improve any AI model, machine-learning system, or competing service; (b) reverse engineer or extract the AI Models or any portion thereof; (c) scrape, harvest, or aggregate AI outputs in bulk; or (d) build a competing product or service. Any breach of this provision constitutes a material breach of the Terms of Service and authorizes Kornugle to terminate your access immediately and to seek injunctive relief and monetary damages.
Section 6 — Human oversight for significant decisions
For any decision about you that produces legal or similarly significant effects (such as denial of an insurance policy, denial of a mortgage application, declination of credit, or termination of an account for fraud), a qualified human reviewer is involved in the final decision. AI is used as a decision-support tool and not as the sole decision-maker for any such legally significant outcome. This commitment is intended to comply with CPRA, CO-CPA, EU GDPR Art. 22 (where applicable), and similar laws.
Section 7 — AI persona identity
Every Kornugle-operated AI assistant identifies itself as an AI on the first turn of every conversation. Our AI assistants do not claim to be human and do not impersonate licensed individuals. When you ask “are you a real person?” the assistant will answer that it is an AI assistant and will route you to a human if you request one (typically by typing AGENT or AGENTE).
Section 8 — Supersession
This AI Disclosure supplements, and is incorporated by reference into, our Terms of Service and Privacy Policy. To the extent of any conflict between this AI Disclosure and the Terms of Service, the Terms of Service govern. To the extent of any conflict with our Privacy Policy, the Privacy Policy governs only with respect to information-handling practices; this AI Disclosure governs everything else relating to AI.
